Register with the West Virginia Department of Health and Human Resources

The next step in getting your West Virginia medical card after being certified by a doctor is to register and apply online with the West Virginia Department of Health and Human Resources. To register, patients will need to have:

West Virginia recently added cannabis flower to the list of approved forms of medical marijuana allowed in the state, meaning virtually ALL forms of medical marijuana will be available for purchase at state licensed dispensaries. Can I grow my own medical marijuana or can my caregiver grow it?

No. The state does not allow patients or caregivers to cultivate medical marijuana. Only a state-licensed cultivation facility can grow medical marijuana.

Will anyone be able to find out that I am a West Virginia medical marijuana patient?

Can my employer still administer a drug screening for marijuana if I am a legal medical patient in West Virginia?

Yes. With West Virginia being an at-will state and there not currently being any legislation in place that protects medical marijuana patients in the workplace, medical cardholders can still be administered drug screenings and receive disciplinary action regarding the results of drug screenings. For this reason, we recommend making sure you are fully aware of your employer’s policy regarding drug screenings and medical marijuana before moving forward with the process.

Can I Still Get a West Virginia Medical Card If I’m on Probation or Parole?

West Virginia does not have any restrictions regarding patients on probation or parole, however, you must get permission from your probation or parole officer first before pursuing a medical marijuana card.

What happens if I am stopped by law enforcement?

As a legal medical marijuana patient, you are protected. Patients do not have to disclose that they possess medical marijuana and do not have to consent to a search. However, if a search is conducted and medical marijuana is found, the patient should immediately present their patient ID card or direct law enforcement to the state patient registry to show that they are a legal patient.

Do West Virginia dispensaries recognize other state medical marijuana ID cards?

No. You must be certified in West Virginia by a registered medical marijuana doctor to legally access and purchase from dispensaries in the state.

Can I use my West Virginia medical marijuana card in another state?

Yes, there are multiple states currently accepting West Virginia medical cards including Pennsylvania and Washington D.C.
